Terms and Conditions

 

K’uk Tours is a Guatemala based adventure, nature, and cultural travel company, fully licensed and registered under the various departments of the Government of Guatemala. K’uk Tours (hereinafter referred to as ‘the Company’) requests the customers (hereinafter referred to as ‘you’) read and understand the Terms and Conditions set by the company before the declaration of booking any package. This set of Terms and Conditions is a legally binding contract between the company and the customer, for the services to be provided by the company and contains information about the procedures of Booking Confirmation, Payment, Refund System, Cancellation, and other charges levied as per policy.

K’uk Tours Trip Booking Terms and Conditions

Booking:

​

All bookings are made with K’uk Tours S.A. located at Antigua Guatemala, Guatemala, Central America.

The term ‘trip’ on the website and the booking conditions refers to all itineraries described on this website, including those, which might otherwise be known as hiking, tours, treks, trips, mountaineering, expedition, excursions, or holidays.

A filled Booking Application Form, with 20% of the payment of trekking/hiking/tour /expedition cost per person, a non-refundable booking deposit, is required to confirm the booking.

​

 The balance due amount is payable 2 weeks prior to the trip departure date. The final trip document will be released upon full trip payment.

 

Cancellation policy

 

Written notification of your cancellation is required to cancel your trip. The date of trip cancellation is the date on which the written cancellation is received by the company.

All cancellations must go through our office by email to info@kuktours.com or bwa@kuktours.com.

Cancelation fees and charges   

As we start to incur costs from the time the contract is confirmed we will apply cancellation charges as shown below from the time when written notification of the cancellation is received:

 

Cancellation of Day Tours

​

For all bookings of day tours a minimum of 24 hours’ notice of cancellation prior to the scheduled tour departure is required for a full refund. If a cancellation is made with less than 24 hours’ notice prior to departure no refund is given.

For the 24-hour policy to be applicable written cancellations need to be delivered to K’uk Tours email address info@kuktours.com / bwa@kuktours.com / beast.wildlife.adventures@gmail.com  The 24-hour policy does not honor cancellation requests sent through other channels.

Cancellation of multi day, group, trekking and mountaineer tours.

​

Cancellations with more than 30 days’ notice before trip departure:

You will be refunded 80% of the total tour price. 20% is non-refundable, as this represents our direct cost of booking and preparing your tour.

​

Cancellations with less than 30 days’ notice before trip departure:

You will be refunded 50% of your total tour price. 50% is non-refundable, as this represents our direct cost of canceling any arrangements made for your tour.

Cancellations with less than 48-hours’ notice before trip departure:

No refund will be given if tours are canceled with less than 48 hours’ notice, as K’uk Tours will be charged for all costs such as guides, transport etc.

Cancellations of Private & Tailor-Made Tours

Cancellations made with more than 8 weeks’ notice (prior to departure):

You will be refunded 80% of the total tour price. 20% is non-refundable, as this represents our direct cost of booking and preparing your tour.

Cancellations made with less than 8 weeks’ notice:

You will be refunded 50% of the total tour price. 50% is non-refundable, as this represents our direct cost of canceling any arrangements made for your tour.

Cancellations made with less than 4 weeks’ notice:

No refund will be given if tours are canceled with less than 4 weeks’ notice, as K’uk Tours will be charged for all costs such as guides, transport etc.

If a tour is booked with less than 8 weeks’ notice, please ask for a customized cancellation policy.

Other Cancellation information 

​

  • “No Shows” will not be refunded.

  • No refunds will be made if the customer voluntarily leaves the trip for any reason, after the trip departure day.

  • K’uk Tours reserve the right to cancel your trip with your safety in mind.  The company holds all rights to cancel any trip, including a guaranteed trip, prior to departure, if under unavoidable circumstances like natural disaster, canceled flights, strike, industrial action, wars, riots, quarantine, government intervention, weather and health condition or any other untoward occurrences. In such a situation, the booking deposit, that is, 20% of the total amount remains non-refundable. However, the remaining trip cost, that is 80% of the total trip cost, if already paid to the company will be refunded but there will be less 17% Gov tax.

  • The tours can be cancelled due to safety reasons or other natural conditions, with short notice. Refunds will be at the discretion of K’uk Tours, if you are involuntarily forced to leave a trip for any reason

  • No refunds will be made for any accommodation, transport, sightseeing, meals, or services not utilized. However, these conditions are subject to change. The company reserves all rights to cancel any trip booked by you before it is guaranteed to run. A trip is guaranteed to run once it has two fully paid travelers, unless minimum numbers state otherwise.

Note: We don’t refund if the client is late or doesn’t show up, or if the weather is not good and the tour is still on schedule.

 

Services Missed or unused

​

There will be no discounts or money refunded for missed or unused services, this includes voluntary or involuntary termination/departure from tour i.e., sickness, death of a family member etc. late arrival on the tour or premature departure either voluntary or involuntary.

Travel Insurance:

We require you to get insured against medical and personal accident risk, before joining any tour with us. The insurance must include medical coverage, air ambulance, and helicopter rescue service. The company also strongly recommends that you take out cancellation insurance. You should be aware that some policies do not include, or restrict, cover for this type of travel. We strictly recommend you ensure that your policy provides an adequate level of protection and covers you for the activities involved. You must carry proof of insurance (insurance certificate) with you on the trip. If you fail to provide this at the start of the trip, you will be required to take out a suitable policy at that time. If this is not done or impossible for practical reason, then you will not be allowed to continue with your trip and will not be entitled to any refund for services not provided.

Injuries and evacuation

​

K’uk Tours would not be liable for any injury/health conditions/emotional or other conditions suffered by the client during the trip.  Similarly, our package cost does not include any personal insurance.  Hence, we advise the clients to take adequate insurance packages, including medical emergencies and evacuation by helicopter.

Facilities and Flexibility:

 

K’uk Tours expects you to understand that on some of our adventure and nature trips, accommodation, transportation, safety, hygiene, telecommunication facilities, level of infrastructure development and medical facilities are not the same that at your home or any other conventional holidays. This type of experiences inherently involves a certain level of personal risk, which you agree to fully assume.

You understand that during the trip certain unforeseen events like accidents or illness in remote places without formal medical facilities, political instability and disasters can occur. You agree to assume all risks associated with the journey to the maximum extent permitted by Guatemalan law. You acknowledge that the trip requires a degree of flexibility and understand that the trip route, accommodation, and modes of transportation are subject to change without prior notice due to local circumstances.

If recommended to amend the itinerary for any reason, the company may do so by shortening, varying, or re-routing any trip. These changes are binding, and additional expenses will be charged to you if the reason for any alteration is outside the company’s control.

While traveling with K’uk Tours, you always agree to accept the authority of the trip leader and guide. You are aware that travel within a group may involve compromise to accommodate the diverse desires and physical abilities of group members. You understand that the company reserves the right to decline, accept, or retain any person as a member of the group any time.

You acknowledge that the company contracts with a network of companies, government agencies and individuals, to assist in the smooth running of its tours, to the best of the company’s knowledge, these third parties are qualified to perform their duties. However, the company will not be held liable for any injury, damage, loss, delay, or irregularity that may occur due to the behavior of these third parties.  The company will not accept responsibility or liability for any traveler, who contravenes any law or regulation of any country visited.

No employee, representative or agent of the company other than the company head or director is authorized to vary these conditions. This agreement is governed by the laws of the Government of Guatemala. Please refer to the Tip Inclusion page along with the itinerary for each trip inclusion detail.

Most of the trip prices do not include the following:

  • Personal travel insurance both Emergency Medical and Evacuation

  • Visa, passport, and vaccination charges

  • International flight to/from Guatemala

  • Extra meals, transport costs, accommodation cost and other expenses not included in the itinerary

  • Laundry, postage, personal clothing (unless provided in the itinerary), medical expense and items of personal usage

  • Emergency evacuation and/or searches

  • Services not mentioned in the itinerary

  • Tips and excess baggage charge

Your trip cost does include transfers to and from the destination airports. We will pick you up from the airport in Guatemala City or the destinations we run our trips. Prior to your departure, your meeting point will be at the specified hotels in Guatemala City, Antigua, or Flores, unless otherwise specified.

Health and Physical Condition

​

For our adventure tours and some of our nature travel experiences; participants must be in a good health and physical condition. It is vital that participants with pre-existing medical problems or conditions make these known to the company at the time of booking. Medical and evacuation expenses are the responsibility of the participant. It is also important that you consult your doctor for vaccination and other medical requirements for your trip before you depart. The company reserves the right to ask for a medical certificate, prior to booking your trip or departure.

The company reserves the right to re-route treks or use road transport for extended delays without any impact on the trip cost. The company does not accept any responsibility for cost incurred because of missed international flight connection, but will fully assist to make alternative arrangements, where possible with extra cost.

In the event of civil unrest within a region or country, we undertake to inform our clients of the situation as soon as we have the knowledge of it.

These booking conditions may only be waived in special circumstances and in writing by a letter from a Director of the Company. The terms and conditions of all agreements made with K’uk Tours shall be subject to and governed by Guatemalan law.

When making your booking you agree to have read and agree to the booking terms and conditions and abide by them and you understand what is involved in participating with K’uk Tours in your chosen trip.

Assumed risk & Outdoor activities

​

Guests/Clients are advised that all activities are undertaken entirely at their own risk, and they must always behave in a fit and proper manner in accordance with K’uk Tours or their partners’ guidelines and must take proper responsibility for their own safety. All adventure tours and outdoor activities carry inherent risks and K ‘uk Tours or its partners do not assume any responsibility for accidents that are caused by its customers or can be traced to their own actions or are caused by factors outside of human control (Force majeure). With the purchase of your trip, you agree to these conditions, understand its implications and accept responsibility for your participation in your trip. Depending on the excursion, you may be requested to sign an additional liability release.

Clothing

​

During our treks and mountaineer expeditions, appropriate footwear and suitable outdoor clothing must be worn. We reserve the right to refuse participation to customers who are dressed inappropriately or with inappropriate footwear since this will put the client’s well-being and safety at risk.

Luggage


Please note that we cannot be held responsible for damaged luggage if it is taken on the tour.

Alcohol and drugs

​

We reserve the right to refuse participation to clients we believe are under the influence of alcohol or drugs, in such circumstances, no refund shall be given. Our guides reserve the right to refuse participation to any customer whose conduct or manner is likely to cause offence, upset or put other passengers in danger. In such cases, full cancellation charges apply.

Updating terms and conditions

​

K’uk Tours reserves the right to update and amend these terms and conditions at any time.  It is the responsibility of the client to keep updates with any changes.  The current terms and conditions will always be found on the website www.kuktours.com and www.bwaguatemala.com and will be the terms referred to in any dispute.
